Sure enough, the mouse that came with it is not responding properly in CS3 but the pen does work. Trying my old mouse, I confirmed that it is in fact a problem with the mouse that came with the graphic pad. Yes, you can clone from any opened image in photoshop. You can do exactly like when you working in the same image. All you have to do is, you have to switch to source file make a sample and go back to file you’re working and start painting.

For example, if you want to clone some part of image A to Image B.
1. Select Clone Stamp tool, with in Image A. Hold down Alt(windows) or Option (Mac OS). Left click at the point you want to make a sample.
2. Go to image B and start painting at the point you need to begin

That's exactly what I was talking about. In previous versions you could have any number of files open and sample data on any one of them without having to actually click on the file to make it active. I guess that you find the “stop cursor” because you try to sample from the image that not active. You just switch to source image, take a sample and go back and painted in to your working file.
